Abstract
本研究以法規範對家庭制度的影響--『引導功能理論』為基礎,檢視並探討當前家庭法的三個 重要議題:性別平等原則在家庭場域中的落實,婚姻制度面對內外的挑戰,包括同居制度以 及同性婚姻合法化等風潮,所必須進行的重新建構與定位,以及高齡化社會中的家庭法制如 何發展,並檢討國家,家庭以及個人的責任分工,以強化家庭功能,因應少子化以及高齡化 所帶來的社會衝擊。此三個議題在學術上以及實務上對我國家庭法的發展具有重要意義。此 外,本研究對於這三個議題的討論,不但具有與國際上所關心的家庭法研究對話的可能性, 本研究所建構的法規範引導功能理論,也能夠協助勾勒法律影響社會的動態樣貌,以對法與 社會研究的發展與深化有所貢獻。 
This three-year project plans to develop a legal framework featuring the channeling function of the law, especially the family law. This legal framework will be used to analyze three important family law issues in today’s Taiwan: women’s (remaining) subordination in the family, the crisis of the institution of marriage (the controversy involving cohabitation and same-sex marriage), and the social/legal problems faced by an fast-aging society. The goal of this project is to shed lights on the impact of law on the society, especially on the family system, by asking questions such as: how the law influences people’s attitude and behavior involving family and marriage and the limits of law.
